Trusts in Bermuda

Bermuda is recognized amongst estate planning professionals as one of the most favored jurisdictions in which to establish a trust.

Bermuda’s trust companies are carefully regulated by the Bermuda Monetary Authority and the Trusts (Regulation of Trust Business) Act 2001. All trust company license applications are carefully screened by the authorities in Bermuda and licenses are only issued to applicants who can show that they have the expertise, infrastructure and capitalization to establish a bona fide trust company with a strong business plan.

Hamilton Trust Company Limited received its trust license in 1992 and is now licensed under the Trusts (Regulation of Trust Business Act) 2001.

Bermuda’s trust legislation is based on English common law. The main bodies of law governing trusts are:

  • Pension Trust Funds Act, 1966 as amended
  • the Trustee Act 1975 as amended
  • the Trusts (Special Provisions Act) 1989 as amended
  • the Perpetuities and Accumulations Act 1989 as amended
  • Trusts (Regulation of Trust Business) Act 2001
